Section 504 Plans

Supporting Your Child with a Section 504 Plan

If your child has a disability that impacts their ability to access their education, a Section 504 Plan may be the means to secure the accommodations and support they need. At Gerard V. Muriello, Attorney at Law, we specialize in helping families navigate Section 504 Plans, providing the expertise and advocacy necessary for effective accommodations.

What is a Section 504 Plan?

Under Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 794), schools are required to provide a Free Appropriate Public Education (FAPE) to all students with disabilities. A Section 504 Plan is designed to help students with disabilities who do not qualify for special education services under IDEA, yet struggle to access their education due to a disability.

“Accommodations” are adjustments to the environment or teaching methods to help the student access the school, classroom, or curriculum. They are intended to “level the playing field”, not change the game. (Wheelchair access ramps at public buildings are a result of Section 504.) In school, accommodations can include extended time on tests, preferential seating, the use of assistive technology, or the implementation of allergen-free zones. A 504 Plan does not provide direct educational services or modify academic expectations.
